These Terms and Conditions (“Agreement”) govern the provision of Non-Emergency Medical Transportation (NEMT) services (“Services”) provided by Drove Rides NEMT, a company based in Mandan, North Dakota (“Provider,” “We,” “Us,” or “Our”) to the clients (“Clients,” “You,” or “Your”) seeking such services. By scheduling or using our NEMT services, You agree to comply with and be bound by these Terms and Conditions.

1. Services Provided
The Provider offers transportation services for non-emergency medical appointments, which may include transportation to and from healthcare facilities, medical appointments, dialysis, therapy sessions, and other medical-related appointments. The services are available to individuals who are eligible under relevant state programs or as otherwise arranged.

2. Eligibility for Services
To be eligible for our NEMT services, You must meet the requirements set by Medicaid, Medicare, or other applicable programs or have made private arrangements for the services. Clients will be required to provide necessary information to verify eligibility, including but not limited to, medical documentation, Medicaid/Medicare information, and appointment details.

3. Scheduling and Cancellations

  • Appointments must be scheduled at least [insert number of hours] hours before the requested pick-up time.
  • Cancellations must be made no later than [insert cancellation period] hours before the scheduled service to avoid a cancellation fee. Failure to cancel within this timeframe may result in a [insert fee] fee.
  • If a scheduled ride is not used or the Client is not present at the agreed-upon time, the Provider may charge a “No-Show” fee of [insert fee].

4. Transportation Services

  • Services include transportation to and from healthcare appointments within the local and surrounding areas as specified by the Client.
  • The Client agrees to be ready at the designated pickup time, and the driver will wait for a maximum of [insert waiting time] minutes.
  • If additional time or services are requested outside of the original agreement, extra charges may apply.

5. Client Responsibilities

  • Clients are responsible for ensuring that they are ready for pick-up at the scheduled time and location.
  • Clients should notify the Provider of any special needs, including mobility assistance, stretcher transportation, or specific medical equipment required for the trip.
  • Clients should ensure that all necessary items for medical appointments (such as prescriptions or medical records) are brought along on the ride.
  • The Client is responsible for ensuring they or their caregivers communicate any changes to the scheduled service in a timely manner.

6. Driver Conduct and Behavior

  • Drivers are expected to maintain a professional and respectful demeanor while providing transportation services.
  • Clients must adhere to appropriate behavior during transportation, and any inappropriate conduct (such as abusive language, threats, or unsafe behavior) may result in immediate termination of the service, and You may be barred from using the Provider’s services in the future.

7. Payment for Services

  • Payment for the Services may be handled via Medicaid, Medicare, or private insurance (if applicable), or directly by the Client if the Services are not covered by insurance.
  • If private payment is required, the Provider will inform the Client of any applicable fees before the service is rendered.
  • The Client agrees to pay all charges incurred for transportation services promptly and in accordance with the payment terms outlined in their agreement.

8. Privacy and Confidentiality
We are committed to protecting your privacy and will not disclose your personal, health, or medical information without your consent unless required by law. All information provided by You, including but not limited to medical data, appointments, and transportation details, will be handled in accordance with applicable privacy laws such as HIPAA.

9. Limitation of Liability

  • The Provider is not responsible for delays caused by weather, traffic, accidents, or other unforeseen circumstances outside of our control.
  • The Provider is not liable for any injury, damage, or loss sustained during transportation unless directly caused by the negligence or willful misconduct of the Provider’s drivers or staff.
  • Clients are encouraged to carry their own insurance or assume responsibility for any potential medical costs or liabilities during transport.

10. Insurance
The Provider maintains general liability insurance and appropriate vehicle insurance in accordance with local regulations. However, the Provider does not provide insurance coverage for the Client’s personal property or health risks while using the service.

11. Modification of Terms
The Provider reserves the right to modify, update, or change these Terms and Conditions at any time. Any modifications will be communicated to Clients through written notification, and the updated Terms and Conditions will be effective immediately upon such communication.

12. Governing Law
This Agreement is governed by and construed in accordance with the laws of the State of North Dakota. Any disputes arising from this Agreement shall be resolved in the appropriate courts located in Burleigh County, North Dakota.
